YardShopper Terms of Service

These Terms of Service ("Terms") govern your access to and use of the YardShopper website, mobile applications, and related services (collectively, the "Service").

By downloading, accessing, or using YardShopper, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Company Information

YardShopper is operated by YardShopper, LLC ("YardShopper," "we," "us," or "our").

2. Scope of the Service

YardShopper is a listing and discovery platform that allows users to post and browse yard sales, garage sales, estate sales, and similar events.

YardShopper:

  • Does not host, manage, supervise, or attend sales
  • Does not sell items or process transactions between buyers and sellers
  • Does not guarantee the accuracy, legality, or safety of listings

All interactions and transactions occur solely between users, and use of the Service is at your own risk.

3. Eligibility

To use the Service, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into these Terms
  • Provide accurate and complete account information

We may suspend or terminate accounts that do not meet these requirements.

4. Accounts and Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account

You agree to notify us immediately of any unauthorized access or use.

You may request deletion of your account by contacting us at yardshopperapp@gmail.com.

Certain information may be retained as required by law or for legitimate business purposes, as described in our Privacy Policy.

5. Listings, Credits, and Payments

Paid Listings

  • YardShopper charges a fee per listing (currently $5 unless otherwise stated).
  • Listings are purchased using virtual credits associated with your account.
  • Credits have no cash value, are non-transferable, and may not be redeemed for cash.

Payment Processing

Payments are processed by third-party payment providers. YardShopper does not store full payment card details and receives only limited payment-related identifiers necessary to manage credits and transactions.

No Refunds

Once a listing is submitted or published, credits are non-refundable, including but not limited to:

  • User error
  • Weather conditions
  • Low attendance
  • Sale cancellation
  • Incorrect addresses or dates

This policy applies regardless of whether the purchase was made through the website, Apple App Store, or Google Play.

6. Location Information

Location data displayed in YardShopper is derived from addresses provided by users and processed through third-party mapping services. YardShopper does not continuously track user location in the background.

Listings are public by design, and location information is visible to other users to enable discovery and navigation.

7. Apple App Store & Google Play Acknowledgements

Apple App Store

If you downloaded the App from the Apple App Store:

  • These Terms are an agreement between you and YardShopper, not Apple.
  • Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support services.
  • Apple is not responsible for claims related to product liability, consumer protection, or regulatory compliance.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play

If you downloaded the App from Google Play:

  • Google is not responsible for the App, its content, or support.
  • Google is not a party to these Terms.
  • Any disputes are solely between you and YardShopper.

8. User Conduct

You agree not to:

  • Post false, misleading, or fraudulent listings
  • List illegal or prohibited items
  • Harass, threaten, impersonate, or harm others
  • Use the Service for unauthorized commercial solicitation
  • Manipulate listings, maps, or system functionality
  • Reverse engineer, scrape, or misuse the Service

You are solely responsible for complying with all applicable laws, local ordinances, HOA rules, permit requirements, and safety considerations related to your sale.

9. User Content

You retain ownership of content you submit, including listing descriptions and images.

By submitting content, you grant YardShopper a non-exclusive, worldwide, royalty-free license to host, display, distribute, and format such content solely for operating, maintaining, and promoting the Service.

10. Content Moderation & Removal

We reserve the right to:

  • Remove or disable listings at any time
  • Suspend or terminate accounts for violations of these Terms
  • Remove content that poses legal, safety, or operational risk

We are not required to provide notice, explanation, or refunds.

11. Reporting Listings

Users may report listings believed to be inaccurate, unsafe, misleading, or inappropriate. Reporting does not guarantee removal. Final decisions are made at YardShopper's discretion.

12. Third-Party Services

The Service relies on third-party providers (including mapping, payments, authentication, and analytics).

YardShopper:

  • Is not responsible for errors, downtime, or inaccuracies caused by third parties
  • Does not sell user data
  • Does not share personal information with advertisers or data brokers

13. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE."

YardShopper disclaims all warranties, express or implied, including warranties of accuracy, availability, safety, merchantability, or fitness for a particular purpose.

14. Limitation of Liability

To the fullest extent permitted by law, YardShopper shall not be liable for:

  • Personal injury or property damage
  • Lost profits, data, or goodwill
  • Errors or omissions in listings
  • Disputes between users

Total liability, if any, shall not exceed the amount paid by you to YardShopper in the preceding 12 months.

15. Indemnification

You agree to indemnify and hold harmless YardShopper from any claims, damages, or expenses arising from:

  • Your listings or content
  • Your conduct on the Service
  • Your violation of these Terms or applicable law

16. Termination

We may suspend or terminate your access to the Service at any time, with or without notice.

You may stop using the Service at any time.

17. Changes to These Terms

We may update these Terms periodically. Changes become effective when posted. Continued use of the Service constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
